Mr. Obama made scrupulously sure that he took the oath of office a second time on the day following his inauguration--to make up for the flawed, potentially constitutionally invalid blooper version he and Justice Roberts did the day before!--but he was strangely cavalier and disingenuous throughout his campaign in the handling of the much larger constitutional question of 'eligibility.'
Well, there's another 'controlling legal authority' that ought to be consulted in this matter.
In reading through the Old Testament book of Deuteronomy, an interesting passage appears at the end of Chapter 17. Moses is rehearsing a number of civil and religious laws for the people to follow as they prepare to enter their new homeland and set up their government and economic/financial systems. Among a plethora of commands and moral and ethical precepts, he includes this brief 'eligibility' requirement to be imposed on whoever the people would choose ("elect") to become their national leader and ruler in times of war and adversity, peace and prosperity:
14 “When you come to the land which the LORD your God is giving you, and possess it and dwell in it, and say, ‘I will set a king over me like all the nations that are around me,’ 15 you shall surely set a king over you whom the LORD your God chooses; one from among your brethren you shall set as king over you; you may not set a foreigner over you, who is not your brother. 16 But he shall not multiply horses for himself, nor cause the people to return to Egypt to multiply horses, for the LORD has said to you, ‘You shall not return that way again.’ 17 Neither shall he multiply wives for himself, lest his heart turn away; nor shall he greatly multiply silver and gold for himself.Did you read that? Aside from the fact that this brief set of qualifications would serve any nation well if its leadership were to implement and enforce it, embedded within this list is what could be considered the original, biblical predecessor to our constitution's 'natural born citizen' requirement.
18 “Also it shall be, when he sits on the throne of his kingdom, that he shall write for himself a copy of this law in a book, from the one before the priests, the Levites. 19 And it shall be with him, and he shall read it all the days of his life, that he may learn to fear the LORD his God and be careful to observe all the words of this law and these statutes, 20 that his heart may not be lifted above his brethren, that he may not turn aside from the commandment to the right hand or to the left, and that he may prolong his days in his kingdom, he and his children in the midst of Israel.
The key verse here is fifteen. I'll cite it again:
15 you shall surely set a king over you whom the LORD your God chooses; one from among your brethren you shall set as king over you; you may not set a foreigner over you, who is not your brother.I'll leave any commentary and biblical exegesis and historical interpretation of this to others. Suffice to say, though, that the idea of natural born citizenship was clearly not just an arbitrary, discriminatory restriction placed in the founding documents of our country by a group of eighteenth-century, narrow-minded white European bigots conspiring to form an elitist government comprised of nothing but their "home boys"!
The fact is, Obama has never demonstrated--with a simple birth certificate like everybody else has to provide to prove their citizenship (not a fraudulently altered "certificate of live birth," which non-residents get in lieu of a birth certificate)--that he meets this qualification. Of course, it has become all too obvious to many, that the powers that be in America no longer care what the Constitution, or the Bible, have to say, especially when these outdated relics do not agree with their socialist agenda.
